General Terms and Conditions of Business, Delivery and Payment

1. Scope of application

For all business relations between To The Pointer - Ramona Enache and the customer, the following General Terms and Conditions of Delivery and Payment shall apply exclusively in the version valid at the time of the order. Ramona Enache-Lorenz does not recognise deviating conditions of the customer, unless Ramona Enache-Lorenz has expressly agreed to their validity in writing.

3. Product range

In the online shop, goods are offered for sale under the conditions stated at the time of the order. The order confirmation, which will be sent to you by e-mail, is decisive for this. All prices stated are in Euro amounts.

The prices always include the statutory value added tax. Shipping and packaging costs will be charged separately.

4. Purchase contract:

Purchase contracts are concluded by acceptance of the order. The acceptance of the order is made in writing by the order confirmation. Should the goods exceptionally not be in stock, we will inform you immediately in writing by e-mail, fax or post. The purchase contract is only concluded when the order is accepted in writing by order confirmation.

5. Delivery times:

Delivery time 3-7 working days within Germany,
Delivery time 7-10 working days within the EU.
Delivery times outside the EU can be 10-30 working days from the date of dispatch.

6. shipping:

The goods are shipped by parcel service with DHL, DPD or UPS. You will receive an e-mail directly from the corresponding service provider as soon as the goods have been dispatched.

Shipping costs:

The delivery costs for the individual articles differ depending on size and weight. The respective delivery costs for your order will be displayed on the shopping basket page.

7. Reservation of proprietary rights

The delivered goods remain the property of Pointer Wine Glass - Ramona Enache-Lorenz until all claims against the customer have been settled in full.

8. Cancellation policy

You have the right to cancel this contract within fourteen days without giving any reason. The revocation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has or has taken possession of the goods. In order to exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear declaration (e.g. a letter sent by post or an e-mail). In order to comply with the withdrawal period, it is sufficient that you send the notification of an exercise of the right of withdrawal before the expiry of the withdrawal period. Consequences of cancellation

If you withdraw from this contract, we must reimburse you for all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the inexpensive standard delivery offered by us), without delay and at the latest within fourteen days of the day on which we received notification of your withdrawal from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you, in which case you will not be charged any fees for the repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us without delay and in any case no later than fourteen days from the day on which you notify us of the cancellation of this contract. The deadline is met if you send the goods before the expiry of the period of fourteen days. You shall bear the direct costs of returning the goods if the delivered goods correspond to the ordered goods and if the price of the goods to be returned does not exceed an amount of 40 euros or if, in the case of a higher price of the goods, you have not yet provided the consideration or a contractually agreed partial payment at the time of the revocation. Otherwise, the return shipment is free of charge for you.

You only have to pay for any loss of value of the goods if this loss of value is due to your handling the goods in a way that is not necessary for checking the condition, properties and functioning of the goods.

The right of withdrawal does not apply to distance contracts for the delivery of goods that are made to customer specifications or clearly tailored to personal needs (custom-made products).

9. Return costs

You have to bear the regular costs of the return shipment if the delivered goods correspond to the ordered goods, otherwise the return shipment is free of charge for you.

If possible, please send the goods back to Pointer Wine Glass - Ramona Enache-Lorenz as a registered letter with signature or parcel. Please return the goods in their original packaging if possible.

11. Warranty and liability for material defects

If delivered products show obvious material or manufacturing defects, including transport damage, please complain about such defects within one week. Slight irregularities in the surface of the leather are due to the origin of this natural material and are not grounds for complaint.

If possible, please return the goods to us in any case in packaging suitable for safe transport, including stable outer packaging.

The warranty period is 24 months from delivery. The warranty does not cover normal wear and tear. The warranty shall expire if the customer modifies the delivered goods. If the delivered goods are defective, the customer has the choice whether the supplementary performance is carried out by repair or replacement. However, we are entitled to refuse the type of subsequent performance chosen if it is only possible at disproportionate cost and the other type of subsequent performance remains without significant disadvantages for the buyer. If the supplementary performance fails, the buyer may in principle demand a reduction of the remuneration (abatement) or rescission of the contract (withdrawal) at his discretion.

12. Data protection

Ramona Enache-Lorenz uses your inventory data exclusively for processing your order. All customer data is stored and processed in compliance with the relevant regulations of the German Telemedia Act (TMG), the German Federal Data Protection Act (BDSG) and all other regulations relevant to data protection. You have the right to free information, correction, blocking and deletion of your stored data at any time. Please contact [info@tothepointer.com] or send us your request by post. We will not pass on your personal data, including your home address and e-mail address, to third parties without your express consent, which may be revoked at any time. Exceptions to this are our service partners who require the transmission of data for order processing (e.g. seller tools, the shipping company commissioned with the delivery and the credit institution commissioned with the payment processing). In these cases, however, the scope of the transmitted data is limited to the necessary minimum. We use technical and organisational security measures to protect the data we have under our control against accidental or intentional manipulation, loss, destruction or against access by unauthorised persons. However, we would like to point out that we cannot guarantee complete data security when communicating by email.

13. Applicable law, place of jurisdiction and final provisions

The place of jurisdiction for all disputes arising from the business relationship is Berlin, insofar as the customer is a merchant or has no general place of jurisdiction in Germany. The business relationship shall be governed by the laws of the Federal Republic of Germany to the exclusion of the UN Convention on Contracts for the International Sale of Goods to the extent permitted by law. Should one or more provisions of these General Terms and Conditions of Business, Delivery and Payment be invalid, this shall not result in the invalidity of the entire contract.


14. Payment options

Prepayment by bank transfer

The customer will receive an order confirmation by e-mail after the order process has been completed. This confirmation contains the assigned order number as well as all necessary details of the order. The amount is to be transferred to the account of To The Pointer - Ramona Enache. It is important to state the order number in the reason for payment when making the transfer. As soon as the transfer has been credited to the account of To The Pointer - Ramona Enache, the order will be released for processing and the goods will be manufactured and shipped.

The usual bank processing times for advance payment transfers are usually 1-3 working days after the payment order. The delivery time stated in the Online Boutique is therefore only valid from receipt of the advance payment. An order will be cancelled after one week without receipt of payment to the account.

PayPal is an Ebay company that guarantees high security and speed. Pointer Wine Glass - Ramona Enache-Lorenz only uses the service of PayPal. The data required for credit card payment must be provided.
